The following is a letter from Mohammad Mostafaei, a human rights attorney who was recently forced to flee Iran, to the UN Secretary General regarding the situation of Iranian asylum seekers:

With Greetings and Respect,

As you are aware and there exists numerous supporting reasons and evidence, the current social, judicial, and political conditions in the Islamic Republic of Iran are such that Iranian citizens are forced to leave their homeland by legal or illegal means.  This exodus is occurring because Iranians fear repercussion and confrontation with security and judicial forces that alongside the government arrest and torture Iranian people due to their religious, social, and political affiliations.  Inevitably Iranian citizens seeking refuge in other countries can no longer return to their homeland.  If forced, such a return will bring about their arrest, physical punishment, insecurity, denied freedom and tarnishing of their dignity.

At the present time, a large number of Iranian asylum seekers in different countries including Turkey and Greece are awaiting to hear from the UNHCR and governments committed to accepting asylum seekers.  Unfortunately, until now, asylum seekers haven’t been able to benefit from refugee rights recognized by international treaties and regulations.

Due to the current conditions in the Islamic Republic of Iran and especially after the events following the presidential [2009] election, there is not only insecurity for political and social activists, the ordinary Iranian citizens are also in danger.  Since the right to live in a safe and secure environment without pressure from a ruling government is a reserved right for every Iranian, all members of the United Nations are duty bound to welcome and accept  asylum seekers.  However, to our dismay, in most cases, the acceptance of asylum seekers has been dragged for years regardless of their eligibility while others have been denied asylum altogether.

All this is happening while the right to live with security without torture and humiliation and the right to choose one’s residence liberally are amongst the freedoms granted to everyone by the Universal Declaration of Human Rights.  According to the Refugee Protocol ratified on January 31, 1967 and the International Covenant sanctioned in 1966, institutions such as UNHCR that are supervised by the United Nations are directly responsible for the implementation of international treaties and regulations and are required to provide security, dignity and basic human rights to asylum seekers.

Since there are Iranians living in various countries under deplorable conditions and need support to appeal their request for asylum, with deep concerns I hereby request that the United Nations expeditiously contact all member states in order to review the affairs of asylum seekers.  As a result, refugees will be able to relocate to states where they desire to live in security.  It is self evident that prolonging the proceedings for the refugees is against the standards of human rights and ought to be considered as torture and punishment.

نامه محمد مصطفايي به “بان کی مون” پيرامون پناهندگان ايراني

با سلام و احترام؛

همانطور که مستحضريد و دلايل و شواهد عديده اي وجود دارد، وضعيت اجتماعي، قضايي و سياسي کشور جمهوري اسلامي ايران به گونه اي است که به حق و به صورت کاملا موجه، به علت ترس و واهمه از برخوردهاي امنيتي و قضايي غيرقانوني و ناعادلانه و در بسياري از مواقع وجود دستگاههاي موازي با دستگاه قضايي و تشريفات صوري و تحت شکنجه قرار دادن، بسياري از شهروندان ايراني به دلايل مختلف از جمله مذهب، عضويت در گروه هاي اجتماعي و داشتن عقايد سياسي، ناچار گشته اند به صورت قانوني يا غيرقانوني خاک ايران را ترک کرده و به اجبار به کشور ديگري پناه برند به گونه اي که بازگشت آنان به کشور موجبات تحت تعقيب قرار دادن کيفري و ناامني جاني، سلب آزادي و حيثيتي را برايشان فراهم خواهد کرد.

هم اکنون عده ي بسياري از پناهجويان ايراني در کشورهاي مختلف از جمله ترکيه و يونان در بدترين شرايط ممکن در انتظار پاسخ کميسرياي عالي پناهندگان و کشورهاي متعهد و پناه پذير هستند و متاسفانه تاکنون نتوانسته اند از حق پناهندگي که در مقررات و معاهدات بين المللي به رسميت شناخته شده است استفاده نمايند. با توجه به شرايط بوجود آمده در کشور جمهوري اسلامي ايران به خصوص در وقايع پس از انتخابات رياست جمهوري که دلايل قوي حکايت از نبود امنيت براي بسياري از فعالين حقوق اجتماعي و سياسي و حتي مردم عادي دارد اين حق براي هر ايراني محفوظ است که بتواند فارغ از فشارهاي حکومتي در محيطي امن به سر برده و اقامت گزيند از طرفي دولت هاي عضو سازمان ملل متحد مکلفند تا پذيراي پناهندگي پناه جويان باشند ولي متاسفانه در بسياري از مواقع قبول پناهندگي ايرانيان با وجود توجيه صحيح و قابل پذيرش، به درازا مي انجامد و در مواقعي نيز مورد پذيرش واقع نمي شود. اين در حالي است که حق زندگي و امنيت اشخاص، منع هرگونه شکنجه و رفتار خلاف شئون بشري، حق عبور و مرور و انتخاب آزادانه محل اقامت و برخورداري از تمام حقوق و آزادي ها براي هر فرد در اعلاميه جهاني حقوق بشر و به تبع آن پروتکل مربوط به وضع پناهندگان مصوب 31 ژانويه 1967 ، ميثاقين بين المللي مصوب سال 1966 به رسميت شناخته شده است و نهادهاي تحت نظارت سازمان ملل از جمله کميسرياي عالي امور پناهندگان در برابر اجراي معاهدات و مقررات بين المللي مسئوليت مستقيم داشته و موظفند امنيت، حيثيت و حقوق اوليه پناهجويان را احقاق نمايند.

حال از آنجاييکه ايرانياني که به دلايل موجه و مدلل در کشورهاي مختلف در شرايط بسيار نامناسب و نامساعد به سر برده و نياز به حمايت و استمداد براي پذيرش پناهندگي دارند ضمن نگراني عميق، درخواست مي شود هر چه سريعتر با دولتهاي عضو سازمان ملل موضوع تسريع در رسيدگي امور پناهندگان مورد بررسي قرار گرفته تا پناهجويان بتوانند به محلي که خواهان اقامت هستند پناه برده و در امنيت به سر برند بديهي است طولاني شدن روند رسيدگي به امورپناهندگان برخلاف موازين حقوق بشر بوده و نوعي شکنجه و مجازات محسوب مي گردد.
