In an interview with HRANA, Shirin Alamhoei’s attorney spoke about taking on her defense and submitting a request for appeal to the Revolutionary Court.

HRANA – Khalil Bahramian, the newly appointed defense attorney for Shirin Alamhoei, a political prisoner held in the women’s ward of Evin prison who has recently been sentenced to execution for Moharebeh (waging war against God), has appealed the issued order to the Revolutionary Court.

In an interview with Human Rights Activists News Agency (HRANA), Bahramian said that after reviewing Alamhoei’s case he has found no clear evidence of his client being a Mohareb (enemy of God).

Bahramian added that he had taken on Alamhoei’s defense last week and that he will submit a request to the authorities for meeting his client as soon as possible. In addition, with regards to Alamhoei’s latest status, he said, “Mrs. Alamhoei is currently bearing the burden of imprisonment in the women’s ward of Evin prison.” According to a recent phone conversation he had with Alamhoei, his client was not aware of the execution order issued for her case.

Bahramian reiterated that the trial held in the lower court had not followed proper legal principles and that Alamhoei’s previous defense attorney had not challenged the indictment issued by the Revolutionary Court, all of which form the basis of his request for appeal to the court.

Shirin Alamhoei has been sentenced to execution under Articles 186, 187 and 190 of the Islamic Criminal Code on the charge of Moharebeh for allegedly collaborating with an armed political organization. She has also been given a two year suspended prison sentence under Article 34 of Passport Regulations for allegedly crossing the border illegally.  Her trial was held on December 19, 2009, in branch 15 of the Revolutionary Court, with judge Salavati presiding. Her sentence was announced to her former attorney Shami on January 3, 2010.

گزارشی از آخرین وضعیت پرونده شیرین الم هویی

خبرگزاری هرانا – خلیل بهرامیان وکیل شیرین الم هویی زندانی سیاسی محبوس در بند نسوان زندان اوین که به تازگی از سوی دادگاه انقلاب به اتهام محاربه به اعدام محکوم شده است درخواست تجدید نظر در حکم صادره را به دادگاه ارائه کرد.

به گزارش هرانا، آقای خلیل بهرامیان در خصوص پرونده موکلش شیرین الم هویی در گفتگو با این خبرگزاری اعلام کرد که در مطالعه پرونده ایشان مستندات شفافی دال بر محارب بودن موکلش مشاهده نکرده است.

وی افزود هفته گذشته وکالت خانم الم هویی را بر عهده گرفته است و در اولین فرصت درخواست ملاقات با این زندانی را به مسئولین ارائه خواهد نمود، همچنین وی در خصوص آخرین وضعیت الم هویی عنوان کرد “خانم الم هویی هم اکنون در بند نسوان زندان اوین تحمل حبس می نماید و در گفتگوی تلفنی با موکلش متوجه شده است که نامبرده از صدور حکم اعدام در خصوص پرونده اش اطلاعی ندارد”

خلیل بهرامیان تاکید کرد که روند بررسی پرونده در دادگاه بدوی خارج از اصول قانونی بوده است و وکیل مدافع تسخیری ایشان در خصوص کیفرخواست صادره از سوی دادگاه انقلاب دفاعی انجام نداده است به همین منظور در خواست تجدید نظر در حکم صادره را به دادگاه ارائه نموده است.

لازم به یادآوریست شیرین الم هویی به اتهام محاربه از طریق همکاری با یک سازمان سیاسی مسلح با استناد به ماده 186 و 187 و 190 (بند 2) قانون مجازات اسلامی به اعدام و به اتهام خروج غیرقانونی از مرز به استناد ماده 34 قانون گذرنامه به تحمل دو سال حبس تعزیری محکوم شد. دادگاه وی در تاریخ 28 آذر ماه در شعبه 15 دادگاه انقلاب به ریاست قاضی صلواتی برگزار و حکم در 13 دی ماه به وکیل وی، شامی، ابلاغ شده است.
